49 CFR Part 21 – Nondiscrimination in Federally-Assisted Programs of The Department of Transportation
Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, or national origin in programs and activities receiving Federal financial assistance. Specifically, Title VI provides that “no person in the United States shall, on the ground of race, color, national origin, age, sex, creed be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.” 42 U.S.C. Section 2000d.
The Airport and Airway Improvement Act of 1982 (49 U.S.C. 47123) states that the Secretary of Transportation shall take affirmative action to ensure that an individual is not excluded because of race, color, national origin, age, sex or creed from participating in an activity carried out with money received under a grant under this subchapter. 49 U.S.C. 47123
Burlington Interantional Airport, and its employees, airport operators, lessees, tenants, concessionaires, contractors and airlines will not deny public services, employment and program opportunities to any person at Burlington International Airport due to race, color, national origin, age, sex and creed or be otherwise subjected to discrimination pursuant to the Code of Federal Regulations, Department of Transportation, Part 21 -Title VI of the Civil Rights Act of 1964.

49 CFR Part 26 – Participation by Disadvantaged Business Enterprises in Department of Transportation Financial Assistance Programs
The Patrick Leahy Burlington International Airport, operated by the City of Burlington, Burlington, Vermont, hereby publishes a proposed overall goal for its Disadvantaged Business Enterprise (DBE) Program for FFY 2021 – FFY 2023 three-year goal of 3.37%. The proposed overall goal for FY 2021 is 3.56% for all FAA-AIP funded projects, the proposed overall goal for FFY 2022 is 2.79% for all FAA-AIP funded projects, and the proposed overall goal for FFY 2023 is 3.76% for all FAA-AIP funded projects.
The methodology used in developing this goal is available at the Burlington International Airport, 1200 Airport Drive, South Burlington, VT 05403, Monday through Friday, from 8:00 AM until 4:00 PM. The Airport/City and the FAA will receive and consider public comments on the proposed goal for 30 days from the date of this advertisement. These goals are established in accordance with 49 CFR Part 26.

49 CFR Part 23 – Participation of Disadvantaged Business Enterprise in Airport Concessions
Pursuant to United States Code of Federal Regulations Title 49-Transportation, Subtitle A, Part 23 (49 CFR 23), it is the policy of the Burlington International Airport (BTV) to provide Airport Concessions Disadvantaged Business Enterprises (ACDBEs) the opportunity to compete for and participate in the performance of all BTV contracts. The objective of this policy is to achieve the participation of ACDBEs at levels comparable to their availability to provide goods and services to BTV with the ultimate goal of developing their status and expertise so that they may compete for future contracts on an equal basis with other successful non-ACDBE firms.
Definement of Airport Concession:
1. A business located on an Airport that is engaged in the sale of consumer goods or services to the public under an agreement with an Airport, another concessionaire, or the owner or lessee of a terminal.
2. A business conducting one or more of the following activities, even if it does not maintain an office, store, or other business location on an Airport, as long as the activities take place on the Airport: management contracts and subcontracts, a web based or other electronic business in a terminal or which passengers can access at the terminal, an advertising business providing advertising displays or messages to the public on the Airport, or a business providing goods and services to concessionaires.
